Securities Fraud Class Actions and Corporate Governance Actions
  • Wells Fargo Derivative Case: Representation of Taft-Hartley pension fund, as lead plaintiff and proposed class representative, in a derivative action against Wells Fargo’s Board of Directors alleging a breach of fiduciary duty by willfully ignoring the wide-spread fraud by the illegal practice of opening unauthorized deposit and credit accounts for Wells Fargo customers.
  • Western Union Derivative Case: Representation of Taft-Hartley benefits fund, as a plaintiff and proposed class representative, in a derivative action against Western Union’s Board of Directors alleging a breach of fiduciary duty by willfully ignoring its participation in cross-border money laundering.
  • In re Bank of New York Mellon ADR FX Litigation: Representation of a Taft- Hartley pension fund, as a named plaintiff in a class action against The Bank of New York Mellon Corporation and its predecessors and subsidiaries, for harm suffered as a result of BNYM’s conversion of dividends or other cash distributions by foreign companies to holders of American Depositary Receipts (“ADRs”) into U.S. Dollars, a process referred to as “ADR FX Conversions,” in a manner that breached BNYM’s contractual obligations to holders of those ADRs.

  • In re Thalomid and Revlimid Antitrust Litigation: Representation of a Taft-Hartley welfare fund as named plaintiff and serving as Interim Co-Lead Counsel in an antitrust class action lawsuit against Celgene Corporation arising from the defendant’s anticompetitive scheme to delay the entry of generic version of Thalomid and Revlimid, two leading cancer treatments, into the market.
  • In re National Prescription Opiate Litigation: Representation of several Taft-Hartley welfare funds as named plaintiffs against the largest manufacturers of prescription opiates in response to the nationwide prescription opiate epidemic.
  • In re Generic Pharmaceuticals Pricing Antitrust Litigation: Representation of several Taft-Hartley welfare funds on behalf of indirect purchasers of certain generic pharmaceuticals for injunctive relief and to recoup overcharges that resulted from an unlawful agreement among defendants to allocate customers, rig bids, and fix, raise and/or stabilize the prices of certain generic pharmaceuticals.
  • In re Actos Antitrust Litigation: Representation of a Taft-Hartley welfare fund as a named plaintiff in an antitrust class action lawsuit against the brand and generic manufacturers of Actos arising from defendants’ anticompetitive scheme to delay the entry of generic versions of Actos into the market.
  • In re Loestrin 24 Antitrust Litigation: Representation of a Taft-Hartley welfare fund as a named plaintiff and serving the proposed class as a member of the Executive Committee in an antitrust class action lawsuit against the brand and generic manufacturers of Loestrin24 arising from defendants’ anticompetitive scheme to delay the entry of generic versions of Loestrin24 into the market.
  • In re Lipitor Antitrust Litigation: Representation of a Taft-Hartley welfare fund as a named plaintiff in an antitrust class action lawsuit against Pfizer, Inc. arising from defendant’s anticompetitive scheme to delay the entry of generic versions of Lipitor into the market.

  • In re Suboxone (Buprenorphine Hydrochloride and Nalaxone) Antitrust Litigation: Representation of two Taft-Hartley welfare funds as named plaintiffs and serving the proposed class as a member of the Executive Committee in an antitrust class action lawsuit against Reckitt Benckiser, Inc. arising from defendants’ anticompetitive scheme to delay the entry of generic versions of Suboxone into the market.
  • Conrail Train Derailment – Paulsboro., New Jersey: Representation of citizens of Paulsboro, New Jersey and the surrounding towns in an environmental mass tort case against Consolidated Rail Corporation (“Conrail”) and other defendants where defendants’ negligence caused a train derailment caused a tanker to breach while crossing the Mantua Creek Bridge and spew who were exposed to 24,000 gallons (or 180,000 pounds) of vinyl chloride gas – a known human carcinogen.
Employment: Discrimination and Wage & Hour Litigation
  • Representing a proposed class and nationwide collective action of leasing agents, concierge, maintenance and service workers employed at AvalonBay, a national cooperative residential housing company, whose time was improperly labeled as “non-productive hours” and wrongfully denied overtime compensation in violation of the FSLA and NYLL.
  • Representing a United Airlines female flight attendant who was terminated while on FMLA leave and undergoing invitro fertilization treatment in an effort to become pregnant, alleging wrongful termination and pregnancy discrimination in violation of the Pregnancy Discrimination Act, FLMA, ADA, and NYCHRL.
  • Representing the former General Counsel of a multinational pharmaceutical company and certain members of executive management and the board of directors in an arbitration against her former employer for breach of contract, tortious interference and retaliation.
